IndoGreen Mobility Private Limited - National Capital Territory of Delhi (Delhi-NCR)
I. Contractual Consent and Legally Binding Agreement
Binding Agreement and Consent: Your continued access and use of the Services constitutes your definitive, unambiguous agreement to be bound by these T&Cs, establishing a legally enforceable contractual relationship between you and the Company.
Affirmation of Capacity: You unconditionally represent and warrant that you are at least 18 years of age and possess the full legal capacity to enter into this contract under the Indian Contract Act, 1872.
Waiver of Prior Terms: These T&Cs expressly supersede any and all prior oral or written agreements or arrangements between you and IndoGreen related to the subject matter hereof.
II. Nature of Service and Aggregator Liability
Digital Facilitator Status: You formally acknowledge and concur that IndoGreen operates exclusively as a digital intermediary/aggregator, providing a platform for connecting you with third-party transport service providers (Drivers/TSPs).
Absence of Employment Relationship: IndoGreen does not provide transportation services and holds no direct employment relationship with the Drivers. Consequently, the primary contract for transport service remains exclusively between you and the Driver.
Acceptance of Intrinsic Risk: You accept that all inherent risks associated with availing services from an independent contractor are borne by you, and the Company is absolved of responsibility for the acts or omissions of the Driver.
III. Waiver and Limitation of Company Liability
Exclusion of Consequential and Indirect Damages: IndoGreen shall not, under any circumstances, be liable for any indirect, incidental, punitive, special, exemplary, or consequential damages, including, but not limited to, damages for loss of profits, data, or business interruption.
Total Liability Cap: Notwithstanding any provision to the contrary, IndoGreen's aggregate and total liability to you shall be definitively limited to the Total Ride Fee paid by you for the single disputed transaction which gives rise to the claim.
Disclaimer of Vehicle Warranty: The Company expressly disclaims all statutory and implied warranties concerning the condition, suitability, quality, or merchantability of the third-party vehicle or the transport service provided.
